The federal appeals court has maintained a prohibition on deploying state troops in Portland, Oregon, following a recent legal decision.

Judicial Panel Concurs to Reconsider Legal Matter

The federal appeals court ruled on Tuesday that it would rehear the legal dispute concerning the executive power with an expanded group of 11 judges. The judicial body also vacated a previous ruling from a three-judge panel that had sided with the administration.

Legal Saga Over Military Presence

This order represents the most recent turn in a long-running court case over whether the former president has the authority and justification to send state military units in Portland. Approximately 200 federalized guard members have been in limbo since the end of September when the mobilization attempt was started in response to ongoing demonstrations.

Differing Viewpoints

The federal government has claimed that federal officials at the immigration center in south Portland were under attack, while local authorities maintain that local officers have control of the circumstances.

Contrary to descriptions of Portland as a conflict zone, residents have been sharing footage of scenic paths and a thriving food scene, and organizing activities such as an protest bicycle event against the “militarization of our city”.

Court Proceedings

The Tuesday ruling came after a US district judge in the city enacted two temporary restraining orders this month – one preventing the federal control of the state troops, and another prohibiting the deployment of any military personnel in the state, after attempts to circumvent the first order by calling up troops from California.

On Monday, the appeals court had put the first ruling on hold – allowing control of state troops – but the second ruling remained in place, blocking the physical sending of the troops.

Full Panel Consideration

The latest ruling means the issue will be heard “en banc” – with all decisions under review simultaneously – by a panel of eleven justices.

“This ruling demonstrates that facts are important and that the judicial system are striving to hold this administration accountable. The founding document limits the executive authority, and Oregon’s communities cannot be treated as a training ground for expansive government power,” stated the state attorney general in a official comment.

“The court is sending a definite signal: the executive leader cannot dispatch the military into American urban areas unnecessarily. We will continue protecting state legislation, values, and autonomy as this case moves forward and our legal battle continues in the judicial system.”
